About

Philip S. Haney, LL.M, JD, has more than 40 years of experience practicing charity, nonprofit, and philanthropic law. His expertise lies within the realm of Federal nonprofit law and the application and use of the Internal Revenue Code. Mr. Haney represents individuals and organizations in the United States and abroad, including 501(c) schools, academies, institutions, humanitarian organizations, estates, trusts, charities, churches, private foundations, and individual philanthropists.

Nonprofit organizations require the expertise of an attorney who understands their specific legal obligations. While nonprofit organizations are similar to corporations in certain aspects—e.g. rolling stock, buildings, leases, sales, budgets, and audits—critical differences exist between them, requiring the ability to identify issues and resolve them in the context of the applicable law.

Mr. Haney’s expertise is the result of forty years of assisting both start-ups and mature nonprofit organizations with annual Federal filings, tax-exempt compliance laws, grants, fundraising, information return disclosure, best practices governance, and applicable laws, regulations, and rules. He also counsels in crisis management and organizational structure and design and assists nonprofits with their related for-profit businesses.

Having a passion for philanthropy, Mr. Haney is particularly adroit when it comes to understanding the subtle nuances and technical regulations that differentiate public charities from private foundations. As an example, he can assist philanthropists with donations to both public charities and private foundations, such as forming a sponsorship or donating a monetary gift to an alma mater.

In 2006, Mr. Haney represented the Eugene B. Adkins Estate art collection, resulting in its stewardship with the University of Oklahoma’s Fred Jones Jr. Museum of Art and the Philbrook Museum of Art in Tulsa.

Mr. Haney also has expertise in governance matters, which he has acquired by serving on several boards. Of note, he is the 2016 Event Chairman of the American Diabetes Association (ADA) Concours for the Cure, a vintage, classic, and antique car show. He is also a member of the Board of Advocates for Street School in Tulsa, Oklahoma, “an alternative high school and therapeutic counseling program for at-risk youth and their families.” Additionally, he serves on the board of the Barthelmes Foundation, Inc. for the Barthelmes Conservatory, a school for gifted music students.

Because Mr. Haney recognizes that legal precision is critical to a nonprofit’s life-long success, he has made it his life’s mission to help charities, nonprofit organizations, and private donors minimize legal risk so that they can focus on what’s truly important—serving their communities.

Mr. Haney is admitted in Oklahoma, and is a member of the Oklahoma and Tulsa bar associations. Mr. Haney is not admitted to practice in the District of Columbia.
